It may seem almost too simple, but for KenPinto, a supply-side expert with years ofexperience working with home andcommercial building companies, the biggestproblem on any given construction project isoften a matter of communication.Or, as Pinto puts it, “an amazing lack ofcommunication among the parties involved.”“For years, people within the home buildingindustry have patted themselves on theback, talking about the great relationshipsthey have with their subcontractors,” saysPinto. “But very often, a lot goes unsaid, andthings are simply assumed.”Those assumptions, asserts Pinto, who is theowner of Kenzai USA, a Dallas-based supplychains solutions company, means that fartoo frequently, both builders andsubcontractors are not entirely sure whenmaterials are really supposed to bedelivered, how much they will cost, andwhether or not the delivery schedules meshwith the building schedule.“It’s all a matter of asking questions, “saysPinto, “which happens far less on manyprojects than you might imagine.”That especially applies to subcontractors.They know a lot, says Pinto, but buildersaren’t going to learn from what is a valuablegroup of experts unless they take the time toask them about matters relating to costsreduction, increased production capacity,and decreased construction cycle time.“So much of these things just comes down tobasic communication,” says Pinto, a processhe says is lacking in the building industry.In response, Pinto has recently published abook called How Much is The Milk?, which isdevoted to exploring the ways in whichbuilders and managers can both lower projectcosts while also considerably reducing projectschedules.The unique title for the book stems from asimple concept: “It’s amazing, but very oftenhow much things may cost, such as buildingmaterials, doesn’t come up that much on aproject. Things are assumed,” he remarks.“Can you imagine walking into a grocery storethat has no prices on any of the items on itsshelves?” Pinto continues. “You’re getting a week’s worth of groceries,moving your cart down the aisles, but whenyou get to the cashier, everything’s asurprise,” he says. “You may pay for what youhave selected, but why would you ever goback to that store again? On the contrary, he says, if they see a bottleof milk, there’s no reason why they shouldn’task the daring question: “How much is themilk?”One of Pinto’s initial approaches to makingprojects more profitable comes withconverting lump-sum contracts into unit-price contracts. This means weighing theunit pricing of materials and labor, a processthat many builders resist.But that approach is only the beginning, hesays, noting that the most successfulprojects are the ones employing supplychain management strategies.Pinto is also big on comparing unit prices tocommodities pricing, advising builders in theprocess of the importance of creating abetter flow of products through the supplychain.The idea of ascertaining building materialprices and also firming down exactly when agiven material is expected to arrive, saysPinto, is perhaps more important now thanever given the nation’s current supply chaincrisis.“I’m afraid that people are going to get tiredof this subject because it’s in the news somuch,” he remarks. But, Pinto contends, thevery fact that it is a timely subject shouldunderline the importance of builderscollaborating with supply chain vendors andtruly getting a grip on the supply chainplanning process.Tackling such challenges, from the first dayof any building project and even before, cannot only significantly reduce the cost ofbuilding a home, but in the context oftoday’s immediate needs, can importantlyhelp to reduce the nation’s current housingshortage.“The more people communicate and takecontrol of the supply chain,” says Pinto, “themore projects will get built.” Pinto got into the business as a carpenterwhile still a boy before becoming a tradesmanand eventually moving into the purchasingand supply chain management end of theindustry.BUILTENVIRONMENTCopyright: Ken Pinto5VOULME 02 | ISSUE 262022 Construction Reporter, LLC, All Rights Reserved. I’ve learned since taking the helm at AGCNM in March of 2020 that there is one thing thatis certain, and it’s change. Serving the membership of AGC NM issomething I do with my full devotion, as I havedone since joining the AGC NM staff in 2007. This past year was one of growth, change, andopportunity. We made a big step in thecollaboration arena by offering joint events withour sister chapter, ACNM. It has been refreshing to redefine our relationship andmove forward together to unite on common issuesimpacting all segments of the industry.Our accomplishments for 2021 were impressive,considering we are still in the midst of a pandemic thatcontinues to linger on well into the second and now thirdyear. The great news is that our members continued toengage and support initiatives. Members activelyattended events, including the new events we introducedthis year which raised awareness of safety and diversityin the construction industry. We created a new careertrack opportunity for those who have an interest insafety professional training. Our first ever SafetyProfessional Development Program launched in Octoberof 2021 and graduated the first class with a 90% passrate for the NCCER’s CSST exam. There is no otherprogram like it in New Mexico and it has been incrediblysuccessful. We’ve received great reviews and lookforward to offering another class in 2022. As a continuedaccolade to our safety focus in the state, we jointlyhosted AGC of America’s nationally recognized safetyprogram called the Safety Management Training Coursewith ACNM. The event was sold out and is only hosted bychapters that continue to exemplify success in the safetyarena.Other achievements of note include a complete revisionof our glazier apprenticeship curriculum and a move toelectronic course delivery for all apprenticeshipcurriculums. The apprenticeship program has been anevolving effort for AGC NM over the past few years. Theimportance of building a strong, skilled workforce for NMis certainly a major initiative for AGC NM. We want tohelp you identify and train those seeking a career thatpays well and creates stability in your companies. As ourapprenticeship program awareness and recruitmentefforts take off in 2022, we know we will continue towork closely with you to address your needs inprofessional development, skill training and workforceretention.The highlights of 2021 were clearly our members’ desiresto collaborate at joint events and support causes thatdirectly impact the industry. New condominium projects, once amainstay of the nation’s homebuildingmarket, have largely remained on thedownside for most of last year, according toa new study released by the Washington-based Urban Institute.The report, Housing Finance at a Glance,notes that such properties have beengenerally decreasing for the last decade,and adds that the decline may be due to“construction defect litigation and relatedinsurance coverage issues.”In some states, that defect litigation hasbeen pervasive enough to lead to thepassing of legislation requiring greaterproof of structural defects before a lawsuitagainst a builder can proceed.Colorado passed such legislation in 2017.The overall decline in condominium salesrepresents a loss for the first-timehomebuyer market. In late December, Deron Brown was havingtrouble finding a hotel room in Phoenix fora January conference. And from hisperspective, that was a good thing.As president and chief operating officer ofU.S. operations for Edmonton, Canada-based PCL Construction, Brown constantlytries to read the tea leaves of whereconstruction markets are headed.As 2021 turned into 2022, many of thosesigns indicated it was at least in the rightdirection.Beyond the lack of hotel rooms in Phoenix— a signpost for Brown that "people aregetting back out there and doing things" —he's noticed a distinct change in the tenorof PCL's clients across its buildings,industrial and civil divisions. While the COVID-19 pandemic hashammered many areas of commercial realestate, the multifamily sector has emergedas a clear winner. Although apartment rents plummeted inthe early months of the pandemic, theyquickly recovered in early 2021. These rentincreases set the stage for an equallyrobust sales market that drove up theprices of apartment communities. Rent andvaluation growth, taken together, createfertile ground for development. I’m not a landlord. I am not at risk of losing any moneyif a property doesn’t perform. I also don’t get to sharein the profits when the property does well. So do Ihave an ethical responsibility to let a landlord know ifI think the tenant I am presenting to him is less thanstellar?Ponder this: A tenant comes to you and asks to berepresented in his search for new office space. Theircurrent lease will be up in six months and they wouldlike to sign you up as their exclusive tenant rep. Youhappen to have knowledge that this tenant was aconstant problem for their current landlord; always inarrears, exceeding his parking allotment, messing upthe common areas and restrooms, etc.Now many of you will say, “Don’t accept theassignment,” which is a fair statement, and I wouldagree. This isn’t a client I would have any interest inrepresenting. But we aren’t all so discriminating. Manybrokers take this assignment with the full knowledgethat if they are able to find this tenant office space,the tenant will most likely—eventually—breach atleast some of the clauses of the lease.Their rationale is that the landlord should perform hisdue diligence, assess the risk, and then determine theappropriate securitization of the lease with a personalguarantee, letter of credit, cash deposit, or deferredcommissions. Thus, if the landlord is willing to acceptthe risk, why should the broker care?Now, as an SIOR broker, I don’t have to read the Codeof Ethics to figure out what to do. It’s simple: I avoidthis tenant and move on. But if you were to decide toaccept this tenant as a client (maybe it’s a slowmonth), you may want to review the SIOR Code ofEthics and/or your state licensing law as it mightrequire you to disclose these facts about your tenant.But wait…don’t you also have a Duty of Confidentialityto your client?
