The action has been a long time coming.On  February  4,  President  Biden  signed  anexecutive  order  requiring  project  laboragreements  in  all  federal  constructionprojects  with  a  dollar  value  of  more  than$35 million.The order will have a direct impact on some$262  billion  in  current  and  planned  federalconstruction projects, impacting upwards of200,000 workers.In  making  the  announcement,  the  WhiteHouse said the order will “help alleviate themanagement  and  coordination  challengesthat  can  stymie  progress  on  majorconstruction  projects.  This  helps  projectsget  completed  on  time  and  helps  thegovernment  get  the  best  value  fortaxpayers’ dollars.”Biden  has  long  been  supportive  of  projectlabor  agreements.  During  his  presidentialcampaign in  the fall  of  2020, he  remarkedthat  not only  was he  for  PLAs, but  that  hewas  “going  to  hold  company  executivespersonally  liable  for  interfering  withworkers who are attempting to unionize.”“It’s  not  enough  just  to  have  theircorporations pay a fine,” Biden continued. “Ifthey’re  part  of  the  problem,  they  are  goingto pay a personal price.”The  President’s  order  comes  during  a  timewhen  union-organized  strikes  against  largemanufacturing  companies  have  increased,prompting  Time  magazine  to  recently  note:“U.S.  organized  labor  is  having  a  momentafter decades of erosion in both influence andpower,  giving  workers  their  best  chance  inrecent memory to claw back lost ground.”Says  the  New  Republic:  interest  in  unionorganizing  is  “infectiously  spreading  fromworkplace  to  workplace,”  adding  “America  isin the midst of a dramatic labor resurgence.”According to  some  analysts, the  President’spro-union  rhetoric,  coupled  with  his  PLAorder, maybe the most tangible evidence yetof a resurgence in union influence.Well,  maybe  and  maybe  not,  says  NelsonLichtenstein.A  labor  historian  at  the  University  ofCalifornia at Santa Barbara, Lichtenstein, says“Biden may be thinking in that direction, butthere is only so much he can do. But Lichtenstein also notes that Biden hadearlier agreed to a clause in the Senate’s$3.5 trillion reconciliation bill that includedaspects of the Protecting the Right toOrganize Act. That provision would make iteasier for unions to organize, creating in theprocess monetary penalties for companiesthat violate labor laws.“That ended up going nowhere,” remarksLichtenstein of the larger legislation that hasyet to win the backing of a majority ofSenators. “That means that both Biden and the unionmovement only have so much influence,”adds Lichtenstein. But Carla Kugler, President, and chiefexecutive officer of the Associated Buildersand Contractors of New Mexico, thinksBiden’s project labor agreements executiveorder underlines a kind of union resurgencein the country. Noting that overall union membership in thecountry is today around 11%, down from its1954 peak of nearly 35%, Kugler says theproject labor agreements give to thecountry’s unions a power they did not havejust a month ago.“Employees that belong to a non-unioncompany already have their health plans andtheir 401 Ks. But now they will be forced tosign a union contract for the lifespan of agiven project requiring them to pay intounion pension plans and union health plans,”she remarks.“This means that unless the employees thendecide to stay with the union forever, thefunds the union collects from them willremain with the union,” continues Kugler.“So, these project labor agreements have thepotential of being great things for the unionbecause they can collect funds that they willnever have to return,” Kugler adds.Lichtenstein, who is also the director of theCenter for the Study of Work, Labor, andDemocracy at UCSB, suggests that if labor isseeing an increase in influence, at least inWashington, it may be happening in otherways not everyone pays attention to.“Biden’s appointment of Marty Walsh is agood case in point,” the professor says of thecurrent Secretary of Labor. Noting that Walsh has long served in thetrade union movement and was once thehead of the Boston Building Trades,Lichtenstein remarks: “Secretaries of Laborhave not always come out of the unionmovement. Construction workers are among some ofthe highest paid workers in the economy, earningten percent more than the average worker in theU.S. Their pay rates have continued to climb 5.1percent as labor shortages have made this aworkers’ market.“Government-mandated project labor agreementsundermine the collective bargaining process byimposing a separate agreement in a specific regionthat applies only to a limited number ofconstruction firms and unions. Since few firms canbe competitive while paying two sets of benefits, theorder effectively locks out most workers fromparticipating in federal construction projects.“Limiting the number of firms that can compete forfederal construction projects and imposingagreements that are often more costly than existingcollective bargaining arrangements will inflate thecost of construction projects at a time when firms arealready struggling with labor shortages andskyrocketing materials prices. It also undermines thebipartisan spirit of the new infrastructure bill.“Career civil servants also do not see the benefits ofimposing these kinds of agreements. All of these things are things thatemployees of the tenant’s desire in order forthem to remain employees of certaincompanies,” Branscom says. The previous dip in office employees,Branscom says, is due to a lack of amenitiesassociated with employment. Employers arealso having to create a hybrid fortransitioning employees between work andhome. In 2021, Branscom said she saw asignificant number of individual tenants,government-contracted businesses, andessential businesses who were expanding.These components make office space ripeand ready to occupy in 2022. ABQ CANNABIS SALES APPROVAL PROCESS CAUSES CONFUSIONBy Andy Lyman, NM Political Report 02/8/2022In about seven weeks, adult-use cannabisretail shops are expected to open for the firsttime in New Mexico. But local ordinances andpermitting processes in the state’s mostpopulous city are causing confusion for somethat are hoping to be among those businessesthat start selling non-medical cannabis onApril 1. Last week, the City of Albuquerque’sPlanning Department announced that itwould be accepting applications for“Cannabis Retail Location Approval,” and thatany cannabis business that intends to sellcannabis to the public would need cityapproval. But at least two cannabisbusinesses were under the impression theywere already approved for retail sales. The cannabis business licensing processstarts at the state’s Cannabis ControlDivision. That division requires certaininformation and approval from localjurisdictions before issuing a state license togrow, manufacture or sell cannabis. Matt Muñoz, who is one of three owners ofCarver Family Farm has seen first-hand thesometimes cyclical nature of licensure.Before Carver Family Farm could getlicensed by the state, the company neededproof that its operations were incompliance with local zoning codes. Afterweeks of phone calls and letters, CarverFamily Farm received a letter from a cityzoning manager that stated the company’slocation was approved for cannabiscultivation and sales. “As of the date of this letter, November 3,2021 Cannabis Retail/Cultivation is notprohibited at this location provided thatthe business is duly licensed by the State ofNew Mexico,” the letter read. But after the Planning Department’sannouncement last week and more phonecalls, Muñoz said he was told that hiscompany would have to secure a secondbusiness license in order to be approvedfor retail sales. But it seems that Muñozwas given incorrect information.
