Last year, it hosted some 180 shows and specialevents. In a statement, Ruth McHeyser, a long-standing members of the Historic Boulder's board ofdirectors, remarked that the theater is "one of the recognizable and well-loved buildings inthe city."The $227,000 grant will fund the removal and replacement of fading stucco, while alsorestoring masonry within the structural walls as well as windows and repairing a large crackin the building's facade.33BUILTENVIRONMENTThe ongoing up and down quest on the part of theArizona Coyotes hockey team to build a newstadium is suddenly facing yet one more challenge. The team has had its eye on a site in north Phoenixthat would have room enough for the constructionof both a massive $1.7 billion new arena, as well asa surrounding entertainment district. To acquire the land, which is currently owned bythe Arizona State Land Department, the team wasprepared to participate in an auction conducted bythat department and scheduled for June 29. According to earlier reports, a minimum bidof $68.5 million was required for the 95-acre property, located near the intersectionof Rio Salado Parkway and Priest Drive. But just as the Coyote ownership wasanticipating the auction event, the LandDepartment announced that it is requiring aspecial use permit from the team. Thatpermit, said the agency in a press release, will provide certainty that "the applicant canbuild what it intends to build."In a correspondence with the team, the LandDepartment made certain to add that it isnot uncommon to require applicants tosecure zoning and use permits prior to anauction. In perhaps what might be regarded as anunderstatement for the Coyotes, the LandDepartment also commented: "Weunderstand the delay in an auction is adisappointment for our applicant andmembers of the public," before adding thatthe action is nevertheless a prudent one forthe agency.Once the permits are obtained, the LandDepartment declared, it would work withthe team on the scheduling of a new auctiondate. The decision was badly received by theCoyotes. In a statement, the team said theLand Department action "seriouslyjeopardizes the future of National HockeyLeague hockey returning to the desert."As revenue from Land Department salesand leases go directly to public school needsin Arizona, the Coyotes statementmentioned: "By cancelling the land auction, the State is forgoing millions, and potentiallybillions, of dollars that would have gonedirectly to K-12 education."Exactly what happens next remains unclear, with some reports indicating that theCoyotes will most likely secure the requiredzoning/use permits in the hope of being ableto participate in a future Land Departmentauction.Other sources think the Coyotes may wellnow be planning to leave the Grand CanyonState: "The future of NHL hockey in Arizonaturns bleak," headlined the publication BurnCity Sports. The earlier announced Coyote plans for thenorth Phoenix site included construction ofa 17,000-seat arena, as well as a 3,500-seattheater, 400,000 square feet of retail space, and a practice facility measuring 150,000square feet. The Coyotes had previously wanted to builda $2.1 billion arena and entertainmentdistrict at a 46-acre site in Tempe, only tosee voters there in the spring of 2023 rejectthe plan.34BUILTENVIRONMENTCopyright: Canva pro

Preliminary work is proceeding on whatwill be a massive 3,100-acre rail spurand industrial park site in the centralColorado city of Fountain. The Southern Colorado Rail Park, to bedeveloped by the Edward C. LevyCompany, will go up on the southwestside of the city, and will see the buildingof both light and heavy manufacturing,as well as some commercial space.A sketch plan for the project approvedby members of the El Paso CountyCommission shows the creation of anew rail spur extending from the coal-fired Ray Nixon Power Plant inFountain to just outside the FortCarson US Army post, some 14 miles tothe northwest. The site is located on mostlyundeveloped land to the west ofInterstate 25 and south of the CharterOak Ranch Road.Talk and pre-planning regarding theviability of what will be a rail-servedindustrial complex has been ongoing forthe last decade among the staffs of boththe City of Fountain as well as El PasoCounty.Continues >SKETCH PLANAPPROVED IN ELPASO COUNTY,COLORADO FORBIG RAIL SPURPROJECTBy Garry Boulard, Construction Reporter 06/25/2024Copyright: Canva pro35BUILTENVIRONMENT

A plan to demolish the historic El PasoCounty Coliseum in order to make way forthe upgrade of a nearby bridge appears tonow be inoperative.Reports published earlier year indicatedthat the building, located at 4100 E. PaisanoDrive, might have to be leveled owing to themodernization of the International Bridge ofthe Americas. In April of 2023 it was reported that the U.S.General Services Administration, in chargeof the roughly $700 million bridge project, was contemplating getting rid of the morethan 80-year-old facility, which is severalmiles to the east of the structure. Levy Company, whose headquarters arebased in Detroit and is dedicated to greendevelopment work.A feasibility study, according to countydocuments, has since determined that“there are no fatal flaws” associated withthe project.Besides the new railroad spur, the project isalso expected to see the building of aninternal rail loop designed to “provide trainstorage and expand the area for rail access.”The next step in the project will see theinterested parties presenting an officialpreliminary plan in the months ahead.36BUILTENVIRONMENTCopyright: Canva pro

71WHAT’SCHANGED IN CRESALES TRENDSCrexi’s National Commercial Real EstateReport for May saw some overall positivechanges for property owners. At the top, they saw the asking price per squarefoot climb by 3.76% across the marketplace, accompanied by a cap rate compression from6.82% to 6.6%. While that is good news on thesurface, asking rents aren’t necessarily whattenants pay. Negotiations could result in lowernumbers. Landlords might offer concessions toget tenants to commit to a lease, which reducesnet rent over the term.Percentage growth varied by asset type: retail(7.33%), office (4.41%), multifamily (3.69%),hospitality (3.06%), and industrial (-1.26%).“The rising popularity of e-commerce hasboosted demand for industrial and warehousespace throughout the U.S. in recent years,”Crexi wrote about industrial. “In response, supply surged, leading to a record number ofwarehouse completions entering the marketover the past few years. However, even asasking rates had stabilized earlier in the year, industrial’s asking rate gains look on track topick up as more space is absorbed and comesoff the market.”CONTINUE READING >Copyright: Canva ProBUILTENVIRONMENT

79BUILTENVIRONMENTCopyright: Canva proA simmering real estate market in Arizonahas been ongoing, taking place at the sametime that the state has experienced one ofthe largest population booms in the nation.According to the most recent CensusBureau figures, the state now has just over7.4 million residents. In 2020, Arizona'spopulation stood at 5.1 million. That population increase has been largelyfueled by an ongoing transplant of peopleout of California, a trend particularlynotable in the last four years, as well as amore traditional migration from theMidwest, ongoing since air conditioningbecame a part of the equation in the 1950s.But the demand for housing, and concurrentrise in prices, is now being seen beyond themega-growth cities of Phoenix and Tucson. The Norado report notes that home saleprices are up by 34% in the city of Eloy and30.4% in Tanque Verde--both in southernArizona. But Fort Mohave, in northwest Arizona, just10 miles to the south of Bullhead City, hasalso seen a strong home sales price increasethis year of 16.5%.The Norad report notes that despite all ofthese upward bound figures, Arizona's redhot real estate market of the last halfdecade has subtly changed: it is now merelyhot. The market is "likely to experiencecontinued growth but at a more measuredpace."For all of that, a report earlier issued by theUniversity of Virginia's Weldon CooperCenter for Public Service has projected thatArizona's population will likely increase bysome 26% by the year 2040.That 26% figure represents nearly 1.9million new residents.

100BUILTENVIRONMENTNATIONALLEGISLATIONIn a move that has caught many on CapitolHill by surprise, the Congressional BudgetOffice has announced that its projection forthis fiscal year's federal deficit is now atleast $400 billion higher than earlierthought.Just four months ago, in February, theagency forecast a deficit of some $188billion, and attributed the lower deficit toincreased Internal Revenue Servicecollections. Now the latest projects issued by the CBOsays that increased military aid to Israel andUkraine, along with stepped-up Medicaidspending, and the probable costs ofreducing student loan borrowing balances, among other factors, have all played a partin what is a 27% increase in the federalbudget deficit.Continues >FEDERAL BUDGETDEFICIT SET TOINCREASE BY ASIGNIFICANT $400BILLION, SAYS NEWCONGRESSIONALBUDGET OFFICE REPORTBy Garry Boulard, Construction Reporter 06/20/2024Copyright: Canva pro

In its Update to the Budget and Economic Outlook: 2024 to 2034, the CBO says the currentbudget deficit is $1.9 trillion. "Adjusted to include the effects of shifts in the timing of certainpayments, the deficit amounts to $2.0 trillion in 2024 and grows to $2.8 trillion by 2034,"says the document.Put another way, "Debt held by the public rises from 99% of Gross Domestic Product thisyear to 122% in 2034, surpassing its previous high of 106% of GDP."The only marginal good news is that a current deficit comprising 7% GDP is expected todecline to 5.5% by the year 2027. That figure, however, is significantly higher than the 3.7%deficit figure that has been the rough average since the 1980s. While the Congressional Budget Office has recorded an ongoing increase in tax revenue,Texas Republican Congressman Jody Arrington said it’s clear that such revenue isn't enoughto offset continued higher deficits. The chairman of the House Budget Committee, Arrington remarked that new spending is"undermining the prowess of the U.S. economy, further eroding consumer confidence, andfueling the cost-of-living crisis for American families.""The United States is on a pace to add trillions of dollars to its national debt over the nextdecade," the New York Times reported in response to the new CBO numbers, "borrowingmoney more quickly than previously expected, at a time when big legislative fights loom overtaxes and spending."The increased deficit, charges the National Review, is due to a "combination of policychanges and a gloomier than previously expected economic forecast." The publication goeson to predict that "given the swelling debt burden and higher rates, interest payments willsurpass $1 trillion next year."In a statement, Andrew Bates, White House deputy press secretary, contended that the newCBO numbers underline the need for a Biden administration proposal to raise taxes onwealthier households and corporations. The President knows, said Bates, "that the last thing we should do is flood Main Street withdebt so that Park Avenue can bathe in tax welfare and greedflation." The CBO report "is awarning against exactly that."101BUILTENVIRONMENT

102In a ruling that analysts say could save thefederal government trillions of dollars, the U.S. Supreme Court on a 7 to 2 votehas decided to uphold a controversial taxon foreign income. The tax was part of President Trump’s$1.5 trillion Tax Cuts and Jobs Act thatwas passed in December of 2017 and wasreferenced as a one-time “mandatoryrepatriation tax” applying to those whoowned at least 10% of a foreign companycontrolled by an American entity.A retired couple living in Redmond,Washington named Charles and KathleenMoore challenged the tax in court, asserting that “income” as referenced inthe Trump legislation only applied togains in the form of a payment to ataxpayer, not in an increase in the value ofa property.US SUPREME COURTUPHOLDS TRUMP TAXPROVISION; AVOIDSLARGER WEALTH TAXISSUEBy Garry Boulard, Construction Reporter 06/21/2024Copyright: Canva proSupported by the Washington-basedCompetitive Enterprise Institute, the couple inMoore v. US maintained that they were owed arefund of nearly $15,000 due to taxes theypaid as shareholders in an Indian company, even though they never actually received areturn on their investment. In their suit, the Moores also argued that thetax violated the Constitution’s requirementthat all direct federal taxes must beapportioned among the states. In his written opinion, Justice Brett Kavanaughsaid the issue at hand revolved around thequestion of whether Congress had the right totax shareholders or partners on matters ofboth realized and undistributed income.“This Court’s longstanding precedents, reflected in and reinforced by Congress’slongstanding practice, establish that theanswer is yes,” said Kavanaugh. The decision was hailed by the Adam Green,co-founder of the Progressive ChangeCampaign Committee, who saw it as a form ofa wealth tax. The ruling, Green was quoted assaying in USA Today, “means the fight to taxwealth and rein in billionaire power is alive andwell.”A statement issued by the CompetitiveEnterprise Institute said the decision “lets thegovernment levy income taxes on foreignshareholders who have never received income. We think that is unfair.”As to whether the decision amounted to awealth tax, Kavanaugh said the Supreme Courtwas addressing itself to the “precise and verynarrow question” of the Trump tax legislation. The wealth tax matter, he continued, suggests“potential issues for another day, and we donot address or resolve any of those issueshere.”BUILTENVIRONMENT

103As President Biden and formerPresident Trump prepare to face off onThursday evening in their first 2024presidential debate, a new PewResearch Center survey is indicatingthat differences between theirsupporters may not be as great aspopularly imagined. The just-released survey of just over8,700 scientifically weighted adultsrevealed that both self-identifiedDemocrats and Republicans have agenerally low expectation that thefederal government does the right thing"just about always or most of the time."And both sides express a somewhat highlevel of frustration with the federalgovernment in general - some 60% of allrespondents in total. But in a sustained area of agreement, both Democrat and Republicanrespondents overwhelmingly said theyare against any efforts that might reduceSocial Security benefits.Indeed, the survey showed that 83% ofresponding Democrats and an equallylarge 77% of Republicans agree with thestatement that "Social Security benefitsshould not be reduced in any way."Continues >NEW PEW SURVEYSHOWS SURPRISINGAREAS OF NATIONALPOLITICALAGREEMENTBy Garry Boulard, Construction Reproter 06/25/2024Copyright: Canva proBUILTENVIRONMENT

104Opposition to reducing Social Securitybenefits crosses demographic lines, with79% of white and 83% of black respondentsagainst any cuts. Similarly, 78% of Hispanicrespondents and 74% of Asian respondentswere opposed to benefit reductions.General popular support of the federalgovernment, meanwhile, remains notablylow: only 22% of all respondents said theyhad any faith in Washington doing the rightthing. While that figure must sober thePresident and members of Congress, it isactually up from a dismal 15% recordedduring the Great Recession. All recent figures, however, pale incomparison to the later years of DwightEisenhower's presidency and the three yearsof the John F. Kennedy administration, whenthe level of trust averaged around 75%.Says a narrative accompanying the Pewsurvey: "Frustration toward the federalgovernment is the dominant emotion forboth Republicans and Democrats, regardlessof which party is in control of the WhiteHouse."But in a country that has had functioning andwell-organized Democrat and Republicanpresidential candidates facing off againsteach other since 1856, it is probably notsurprising that partisan anger with thegovernment is "higher when administrationsfrom the other party are in power.Contentment is higher among people whofavor the party of the president."On that note, the Pew survey reveals that28% of registered Democrats said they arecurrently content with the federalgovernment, compared to 8% of theRepublican respondents who said the samething. The Arizona Court of Appeals recentlydismissed a case brought by RepublicanArizona attorney general candidateAbraham Hamadeh, Republican CochiseCounty Supervisor Tom Crosby and anindependent voter who wanted to decertifythe results of the 2022 general election.Experts are now warning that with thisyear's highly contested presidentialelection, challenges to the results are likelyto continue.
