President Donald Trump has launched anaggressive new push to reclaim U.S. controlover critical minerals, invoking wartimepowers to jumpstart domestic production. Trump signed on Thursday an executiveorder invoking the Defense Production Act,a Cold War-era law, to accelerate mining,refining, and strategic mineral developmentacross the United States.The order unleashes federal financing tools,expedites permitting, and re-prioritizesfederal land for strategic mining, while fast-tracking a landmark mineral agreement withUkraine."It is imperative for our national securitythat the United States take immediateaction to facilitate domestic mineralproduction to the maximum possibleextent," the order reads.At the White House, Trump confirmed theU.S. would soon finalize a rare earth accessdeal with Kyiv."We're also signing agreements in variouslocations to unlock rare earths and mineralsand lots of other things all over the world,but in particular Ukraine," Trump said.$14.8 Trillion in Critical ResourcesTRUMP INVOKES WARTIMEPOWERS TO BOOST U.S.MINERAL SUPPLYBy Josh Cutler, The Built Environment03/26/2025BUILTENVIRONMENT04Ukraine holds one of the largest criticalmineral reserves in Europe, with depositsvalued at $14.8 trillion across six locationsand comprising about 111 billion tonnes ofmineral resources. According to Geographical, Ukraine ranksamong the top ten global suppliers, housing22 of the 34 minerals the EU defines as"critical," including rare earths likeneodymium, yttrium, lanthanum, andcerium.Neodymium is crucial for high-performancemagnets used in both defense systems andclean energy technologies. Cerium andlanthanum support applications in lightingand catalytic converters, while yttrium isused in nuclear power generation andadvanced directed-energy weapons.Despite its potential, roughly 40% ofUkraine's metal resources are underRussian occupation, with much of its coaldeposits already lost. According to AP News,Ukraine has framed the proposed deal withthe U.S. as a strategic hedge in case Russiaseizes more of its mineral base."I think it's a smart move from Zelensky as away to convince the new administration,"said Bryan Bille, a policy expert atBenchmark Mineral Intelligence." Plans have been announced for a significantexpansion of the much-visited Children’sMuseum of Phoenix, which is located at 215N. 7th Street in a structure built in 1914. Funding for the project is coming from agrant provided by the Indianapolis-basedLilly Endowment which will support what isexpected to be a 27,000-square-footaddition. The Lily Grant has a dollar value of $2.5million and is the largest ever received bythe museum. Founded in 1998, the Children’s Museummoved into what was formerly the three-story Monroe School about a decade laterafter a $10.5 million purchase andupgrading of the structure. Museum officials have said that theexpansion project is expected to costaltogether around $6.4 million, with some$5.3 million as of last month raised for theeffort. Plans are now underway for facility work ata rapidly growing school district in southernArizona.In November, voters in the Agua Fria UnionHigh School District, which serves the citiesof Avondale, Buckeye, and Goodyear, gave agreen light to a $138 million bond designedin part to fund improvement to facilities onfive separate campuses.The bond, which was narrowly approved ona vote of 50.3% to 49.6%, was deemedparticularly important because many of thedistrict’s structures are at least 60 years oldor more. Preliminary planning is now underway on aproject that will see the initial constructionof some 140 townhomes on a 25-acre site indowntown Mesa.The project, designed to revitalize what theArizona Republic once called a “barrentract,” will see the building of homes ofvarying sizes and all priced at around$300,000.Proposed by the Tempe-based real estatedeveloper Culdesac, the project will go upon a site that has been vacant for the lasttwo decades at the intersection of NorthWilbur Street and E. 3rd Place.That site, bordered by some residential andcommercial structures in the distance, haslong challenged city officials who havewanted to see something built in an areawhere mostly middle-income homes, as wellas commercial structures, were firstpurchased by Mesa at a total cost of $6million in the 1980s, before beingdemolished in the 1990s.The clearing of the land occurred to makeway for a planned resort with a waterparkthat never became reality. New America Schools, a publicly fundedsystem of charter schools serving ages 14 to22, has a location in downtown Las Crucesthat operates in the same building as abusiness marketed as “America’s firstcannabis pharmacy,”Pharmtrue. Roberta Stathis, a vice principal at the NewAmerica School Las Cruces (NASLC), said the institution is looking to further fight azoning variance granted by the Las CrucesCity Council to Pharmtrue.The zoning variance allows them to legallysell cannabis on the property without a 300-foot buffer between any school withunderage students.In November of 2024, district court JudgeManuel Arrieta ordered that the decision bereversed, as to deny the variance after yearsof NASLC’s attempts to appeal. “We are looking at possible ways to have thedispensary follow the law. And we haven’tgone so far as to get an injunction from thejudge that issued the ruling but we’regetting close to that,” said Stathis in aninterview with The Built Environment.In 2022 Pharmtrue and its previousbusiness partner, Mesilla Valley Pharmacy,unanimously won an appeal to NEW MEXICO WEEDFEEDNew America School Las Cruces located in downtown Las Cruces, New Mexico, sharing a building with a cannabis dispensaryconducting recreational sales in February of 2025. BUILTENVIRONMENT98maintain operations next to the charterschool, as reported in the Las Cruces Sun.That smell of victory continues to emanatefrom the remaining cannabis retailer,Pharmtrue.Odors from the operation are seepingthrough the ventilation and into the charterschool and a daycare center owned byNASLC, said Stathis. “We think that they’re also continuing tomanufacture it because we get the smellfrom the manufacturing process,unfortunately, in our daycare center,” saidStathis. Prior to the legalization of recreationalcannabis which contains the psychoactivecomponent, tetrahydracannabidol (THC),Pharmtrue was distilling and extractingcannabis oils containing the non-psychoactive component, cannabidiol(CBD). PharmTrue announced on its Facebookpage that it would begin these laboratoryprocesses in 2020.According to the site, Technology Networks:the manufacturing processes Stathis isreferring to requires shucking and dryingcannabis plants, grinding the plant matter,extracting the oils containing the desiredcomponents using solvents (cannabinoids),cold storage, or in the case of distillation –heat extraction. Cannabinoid extraction methods, such asthose described, involve lab equipmentwhich maintain a closed loop system and thebiproduct of this process doesn’t produceany intoxicating or harmful fumes, accordingto Technology Networks. BUILTENVIRONMENT99“I just know that the stench is quite strong inthat area,” said Stathis.The present odor may not be intoxicating orharmful to the neighboring daycare space,but Stathis said, “it’s obnoxious that we haveto deal with that I think.”“I think all of us on the board would say ‘wehave no problem with the sale of cannabis –that’s not the issue. But we believe that ourschool should be treated like every otherschool in the state,” said Stathis. Stathis has learned quite a bit about zoningvariances over the course of her time atNASLC which predates the cannabisconundrum. One conclusion Stathis has come to is thatlegally the property itself is granted avariance from the standard cannabis zoningcode, not a particular business entity. “The variance is not granted to the business,the variance is granted to the property andthe variance that was granted to thisproperty was for the sale of medicalcannabis,” said Stathis.NASLC’s appeal argues that sincePharmtrue is selling cannabis to bothmedical and recreational users alike, it nolonger falls under exemption for medicinalcannabis zoning. According to the final order reversing theapproved variance filed in November of2024, “Pharmtrue was already serving themedical cannabis need prior the variancerequest,” and that “the record fails to reflectany distinction between Pharmtrue’sinvestment in the pharmacy location that isattributable to CBD or medical cannabis,with the expected investment in retailingrecreational (THC) cannabis.”Medicinal cannabis prior to recreationallegalization contained both THC and CBD. BUILTENVIRONMENT100Judge Arrieta concluded that the grantedvariance for Pharmtrue lacks the substantialevidence to prove that city was following itsown zoning ordinance, preventing usepatterns for students attending NASL thatwere under legal age. In legal proceedings prior to the order,Pharmtrue’s principal, Trey Howard,testified that the building uses securitymeasures to prevent sales to minors with“20 cameras throughout the facility andparking lot, and barred facility windows andlocked rolling gates.”Pharmtrue states online that their vision isto “merge the classic practices of traditionalpharmacy with the healing potential ofcannabis”, and are soon offering vaccinesand prescription management services. Pharmtrue’s Chief Executive Officer andfounder, Dr. Joaquin Acosta, was contactedby The Built Environment for comment. Acosta said that he was unaware of thejudge’s decision and did not provide furthercomment.Acosta was appointed by the Las Cruces citycouncil to serve on its planning and zoningcommission in April of 2024. After retrieving a sample marketed as hempfrom Grass Station’s Smoke Shop, KRQE hadthe product analyzed by Rio GrandeAnalytics which found “the product contains26.5% THC which is potent, high-grademarijuana in disguise.”House Bill 346 seeks to declare anemergency, creating regulations for hempproducts by adding a new section to theHemp Manufacturing Act, and banning thesale of synthetic cannabinoids. Synthetic cannabinoids are a class ofdesigner drugs created to mimic thechemical structure of THC as to evade thedistinction as natural cannabis.Hemp retailers as a result would be subjectto petty misdemeanors, permit revocationand $1,000 fines for selling cannabis withTHC concentrations higher than three-tenths of a percent or that contain syntheticcannabinoids. This state bill passed with seven dissenting votes in the house on March 13th andpassed the senate with zero dissentingvotes on March 22nd. Dan Lewis, an Albuquerque city councilor,introduced an ordinance to ban syntheticcannabinoids being sold in the city with thethreat of penalties, petty misdemeanors andlicense revocation on March 14th.A similar piece of legislation, House Bill 10,on the state level was voted against by onerepresentative and one senator. House Bill 10 would create a bureaucraticlayer of enforcement beyond the NewMexico Cannabis Control Division thatwould seize unlicensed cannabis productsand penalize distributors of said products. A licensee found with products deemedunsuitable by the new bureau could face$10,000 per violation as a penalty. The group has repeatedlyadvocated that the most responsibleapproach to the challenge would seeCongressional members of bothparties coming together to “act beforethe beginning of the X Date range,ideally well before, if they wish toresponsibly protect the U.S. and globaleconomies.”The coming X Date, which someexperts contend could have a windowrange extending to early October, maybe greatly defined by revenue cominginto Washington this spring via federaltax payments.
