A researcher and a construction associationboth agree, a new heat stress rulingproposed in New Mexico lacks practicality. On March 14 , the New MexicoEnvironment Department (NMED)petitioned new protection measures forNew Mexico workers through theEnvironmental Improvement Board. Inresponse the New Mexico Chapter ofAssociated General Contractors of America(AGC NM) is opposing the measures and isencouraging its members to submit data andcomment at future stakeholder meetings. thThe Built Environment contacted aUniversity of New Mexico professor whocontinues to study the impact of heat stressin construction. “Employers need to protect their employeesfrom the reality of heat-related injuries,”said Occupational Health and Safety BureauChief for NMED, Kristy Peck in a release.Peck said that climate change has madeNew Mexico hotter and dryer in the pastfew years. New safety standards to prevent illnessesbrought on by extreme heat, also adoptedby five other states in the U.S. includingCalifornia, Nevada, Minnesota, Oregon andWashington, would take effect in July of2025.NMED states in their release that over 800heat-related emergency room visitsoccurred in 2024. Data published toNMED’s website are only as recent as 2022,and that data suggests there were 373 heat-related emergency room visits that year. Project managers would be required toconduct heat exposure assessments whenthe temperature reaches above 80 degreesFahrenheit – relative to humidity, sunexposure, personal risk factors, and workperformed. Site laborers would be required to takebreaks every 20 minutes for at least 40minutes when the temperature exceeds 90-degree Fahrenheit. Training, monitoring, extended recordkeeping and cooling provisions would alsobecome a part of the ruling’s regiment. “While the intent to protect workers iscommendable, this proposed rule as writtenwould impose substantial strain on NewMexico’s commercial construction industry.A one-size-fits-all mandate does not reflectthe diversity or practical realities of ourworksites,” wrote Kelly Roepke-Orth, chiefexecutive officer for AGC NM, in an internalemail to the chapter’s members on March27th.Roepke-Orth advocated for occupationalheat stress research in 2022. That research was funded by the Center forConstruction Research and Training, and was conducted by a UNM research groupled by Fabiano Amorim Ph.D.Amorim, associate professor in exercisescience at the University of New Mexico,was one of the first to research heat stressexperienced by construction workers inNew Mexico and the U.S. at large in 2023. The Built Environment contacted Amorimwho said that while they support thedirection of the proposed requirements,further data is needed, how protocols will beimplemented is unclear and a one-size-fits-all approach fails to account for job sitevariations. “A federal heat standard is long overdue,and this proposal marks an important andtimely step forward,” continued Amorim inan email response to The Built Environment,“that said, there are specific components ofthe rule that I believe would benefit fromadditional field-based data andclarification.”One such measure called into question byAmorim is the acclimatization requirementwhich would have new employees observedby a supervisor while gradually being re- BUILTENVIRONMENT05Copyright: Canva Pro

introduced to heat conditions over a week. “While I believe that acclimatization is oneof the most important individualadaptations for working in hot conditions,it’s unclear how this protocol is effectiveand will be practically implemented orenforced in real-world occupationalsettings,” said Amorim. Amorim said that their researchers are closeto finishing an analysis of a large-scale studyinvolving 200 workers at a commercialconstruction site in the Midwest.This new study was funded by TurnerConstruction and its partners, FlatironConstruction, Liberty Mutual and ChubbInsurance, in 2024, according to Amorim. That research will be submitted forpublication soon, said Amorim. “Our hope is that data from real-worldstudies, like the one we conducted inpartnership with Turner, can help fill thesegaps and support the development of amore adaptive and effective regulatoryframework,” said Amorim. Although the decision is left to the state’sEnvironmental Improvement Board toadopt the proposed regulation in NewMexico, a federal rulemaking by theOccupational Safety and HealthAdministration (OSHA) is open for publiccomment virtually on June 16 .thStakeholder meetings facilitated by OSHA,designated for the local businesscommunity, are being held in the comingweeks for those who would be affected bythe new regulation.
