A proposal moving through the New MexicoSenate calls for the state to develop acoordinated approach to rehabilitate agingdams, many of which have been in servicefor more than half a century and now faceheightened risk from severe weather andstructural degradation.Senate Memorial 20, introduced byDemocrat Senator Pete Campos, iscurrently under consideration in the SenateRules Committee. The resolution does notcarry the force of law but seeks to drawattention to dam safety concerns and urgestate leaders to establish a statewiderehabilitation program.The memorial notes that most dams in NewMexico are more than 50 years old, withsome exceeding 100, and that outdatedconstruction standards and insufficientmaintenance have left many structures atrisk. Officials have documented flood rescues,infrastructure damage, and evacuations inRuidoso. “We’re seeing what are waterwaysrun that we’ve never seen before and createproblems that we have not seen before,”Lincoln County Sheriff Michael Wood said ina video posted on Facebook during the 2024flood season, as reported by FOX Weather.El Vado Dam on the Rio Chama, anothercritical water infrastructure asset, has beenout of commission since 2022 due to leaks inits steel faceplate. According to the U.S.Bureau of Reclamation, repairs could takeyears. Built in1962 near Chimayo, the dam is consideredto be at risk of failure. According to aConstruction Reporter article, conservationdistrict supervisor Sigmund Silberattributed the dam’s deterioration to its ageand “the fact that the watershed has one ofthe highest sedimentation rates in the U.S.”The federal Natural ResourcesConservation Service has begun designing areplacement, but the project is expected tocost at least $18 million. New Mexico received $3,035,886 throughFEMA’s High Hazard Potential Dams GrantProgram in fiscal year 2024. The grant,supported by the Bipartisan InfrastructureLaw, provides “technical, planning, designand construction assistance… forrehabilitation of eligible high hazardpotential dams,” according to FEMA. On a year-over-year basis, industry employment hasrisen by a mere 143,000 jobs, an increase of1.8%. Nonresidential construction employmentincreased by 22,300 positions on net inMarch, with growth in 2 of the 3 subsegments.Nonresidential specialty trade added the mostjobs, with a monthly increase of 19,300positions, while heavy and civil engineeringadded 3,400 jobs. The nonresidential buildingsubsegment lost 400 positions.The construction unemployment ratedecreased to 5.4% in March and is unchangedfrom one year ago. Although their titles differ by a single digit,among other design differences, both firestations share contractual characteristics.Both contracts were awarded to HBConstruction, both winning bids exceededthe original project estimates in the millions,and both required the awarded generalcontractor to agree to the county’s CWA. In 2020, Bernalillo County commissionerspassed a new ordinance enforcing the use ofCWAs for any public works project that
exceeded $7 million. The county’s CWA requires contractors,both union and non-union, to pay fringebenefit contributions to the county’saffiliated unions’ benefit funds. It also contractually prevents a contractor’sability to engage in lockouts and waives anyunion’s right to strike or interrupt the workcovered by the agreement, among otherterms. Project labor agreements (PLA) such as thison the federal level are being contested asseveral Biden-era executive orders (EO)have been rescinded by the Trumpadministration as of March. construction projects, which increaseconstruction costs by 12% to 20%, reduceworker wages and effectively eliminate 90%of America’s construction industryworkforce from building these projectsbecause they are not members of a laborunion,” said ABC Vice President ofRegulatory, Labor and State Affairs, BenBrubeck, in a release. Fire Station 37 was estimated to cost $8.2million but was awarded to HB Constructionfor $9.7 million. This was despite a lower bidbeing submitted by Anissa Construction,Inc. at $8.1 million in 2022.The latest addition, Fire Station 36, wasestimated to cost $13.5 million but wasawarded to the same general contractor for$16.8 million in 2025. In a county press release, it states that thefire station will cost “approximately $15.8million”.HB Construction was also awarded a countyproject, Mesa Del Sol Tournament Fields, at$10.9 million when the original estimatedcost was $10 million in 2022. Bernalillo County does not have any fiscalanalysis reports specifically covering theimpacts of CWAs on public projects. Construction fund expenditures in thecounty decreased by $1.2 million in fiscal2023 compared to the previous year whilethe fund’s balance increased by $5.2 million,according to the county’s annual financialreport. Plans are underway for reconverting intoresidential space one of the largest officeproperties in downtown Denver.Located at 621 and 633 17th Street, theoffices are made up of two separate towerstructures, comprising 973,000 square feet,one built in 1957 and the other in 1974.Los Angeles developer and investor AsherLuzzato has purchased the structures for$3.2 million with a goal of building around700 apartments in them. In early March, a memo issued by the TransportationDepartment directed agency officials to flag any grantunder the SS4A program centered on "equity analysis,green infrastructure, bicycle infrastructure," and electriccharging station infrastructure for potential removal.That memo, the publication Streetsblog has sincereported, based its authority on previous Trumpadministration executive orders taking aim at the"diversity, equity, inclusion, and accessibility goals of theBiden administration, as well as the previous president'sefforts to reduce the carbon footprint of the nation'stransportation system." But any move in the direction of getting rid of SS4A hasbeen criticized by a number of lawmakers, includingDemocrat Washington Representative Rich Larsen, whosaid that discontinuing projects already awarded underthe program undermines the "federal-state-localpartnership for infrastructure delivery."In a statement, Larsen, who is the ranking member of theHouse Committee on Transportation and Infrastructure,continued: "It is nonsensical to abandon locallydeveloped projects that benefit communities across thecountry." Now Duffy has announced in a Notice of FundingOpportunity that the Transportation Department ismaking available some $982 million for "cities, towns,counties, Tribal governments, and MetropolitanPlanning Organizations" under an updated SS4A.Duffy said SSS4A has been stripped of its environmentaljustice and Diversity, Equity, and Inclusion requirements,efforts which he said were "bogging down the systemand preventing money from going out to where it'sneeded." One of the most vigorous constructionvenues in the past decade may be taking a hitin response to the Trump administration’srecently announced tariff policies.According to the publication Data CenterFrontier, the construction of data centers hastraditionally been dependent on “keymaterials such as steel and aluminum, whichare essential for everything from structuralframeworks to power infrastructure.”Those materials coming from a variety ofcountries, including China, Brazil, SouthKorea, and the United Arab Emirates, arenow subject to increased tariffs. The Wall Street Journal calledTrump’s move “a rethinking of U.S. tradepolicy on a scale not seen since the post-World War II era,” while The Hill observes:“Trump shatters a century of trade policy inone day.”Lawmakers pushed TransportationSecretary Sean Duffy to speed up federallyfunded infrastructure projects in a recentSenate Environment and Public WorksCommittee meeting, as they begindeveloping the next multiyear SurfaceTransportation Reauthorization Bill.The 2021 Infrastructure Investment andJobs Act added about $550 billion overbaseline funding levels and included a five-year reauthorization of federal highway,transit and other infrastructure programsthat is set to expire at the end of September2026.
